Welcome to the website and online services of Truong Buu Diep Foundation (“TBDF,” “we,” “us,” or “our”). By accessing or using tbdf.org, its related pages, features, applications, or services (collectively, the “Services”), you agree to these Terms of Service. If you do not agree, please do not use the Services.

1. About Our Services

TBDF is a nonprofit organization serving the community’s spiritual and charitable needs. Our Services may provide educational and religious information, news, videos, event information, prayer-request features, donation tools, and connections to third-party platforms such as TikTok, YouTube, Facebook, and payment providers.

2. Eligibility and Acceptable Use

You must use the Services only for lawful purposes. You may not misuse the Services, interfere with their operation or security, attempt unauthorized access, introduce malicious code, impersonate another person, infringe another party’s rights, or submit unlawful, abusive, deceptive, or harmful content. If you are under the age required to consent to online services in your jurisdiction, you may use the Services only with permission and supervision from a parent or legal guardian.

3. User Submissions

If you submit a prayer request, testimonial, message, photo, video, or other material, you represent that you have the right to provide it and that it does not violate applicable law or another person’s rights. You retain ownership of your content. You grant TBDF a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and distribute that content only as reasonably necessary to operate, promote, and improve the Services. Please do not submit confidential or highly sensitive information through public forms.

4. TikTok and Other Third-Party Services

Some features may allow authorized TBDF administrators to upload or publish TBDF-owned videos to TBDF’s TikTok account or interact with other third-party services. Use of those platforms is also governed by their respective terms and privacy policies. TBDF does not control and is not responsible for third-party platforms, their availability, or their practices. Account authorization may be revoked through the applicable third-party platform.

5. Donations

Donations are voluntary and may be processed by third-party payment providers. Unless otherwise required by law or stated in writing, donations are non-refundable. Donors are responsible for providing accurate information. Any tax-deductibility depends on applicable law and the donor’s circumstances; please consult a qualified tax adviser.

6. Intellectual Property

The Services and TBDF-provided text, graphics, logos, photographs, audio, video, design, and other content are owned by or licensed to TBDF and are protected by applicable intellectual-property laws. You may view and share public links for personal, noncommercial purposes, but you may not copy, modify, sell, republish, or commercially exploit TBDF content without prior written permission, except as allowed by law.

7. Privacy

Your use of the Services is also subject to our Privacy Policy, which describes how we collect, use, and protect information.

8. Disclaimers

The Services are provided for general informational, religious, and charitable purposes. They do not provide medical, legal, financial, or other professional advice. The Services are provided “as is” and “as available.” To the fullest extent permitted by law, TBDF disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

9. Limitation of Liability

To the fullest extent permitted by law, TBDF and its directors, officers, volunteers, employees, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of data, loss of revenue, or damages resulting from use of or inability to use the Services. Nothing in these Terms excludes liability that cannot lawfully be excluded.

10. Suspension and Termination

We may restrict or terminate access to the Services when reasonably necessary to protect users, TBDF, third parties, or the integrity of the Services, or when these Terms or applicable law are violated. You may stop using the Services at any time.

11. Changes to These Terms

We may update these Terms from time to time. The effective date above will be revised when changes are posted. Continued use of the Services after an update means you accept the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be subject to the courts having jurisdiction in Orange County, California, unless applicable law requires otherwise.
